Join Lisa Foshee, Senior Vice President of Government Affairs and General Counsel of the Auto Care Association, and Paul McCarthy, President and CEO of MEMA Aftermarket Suppliers Group, as they discuss the recent update to the law and the challenges that may arise in enforcing it. The recent decision by a federal judge in Massachusetts to allow the law to go into effect is a big step forward for the automotive industry, but there are still some challenges that need to be addressed. They discuss the limitations of the Memorandum of Understanding (MOU) model for data sharing between Original Equipment Manufacturers (OEMs) and independent repair shops and urge listeners to sign the petition at repairact.com and support the Federal Repair Act, also known as HR 906. Lisa and Paul describe the bill as a reasonable and critical solution to ensure vehicle repairability, safety, and cybersecurity. They stress the need for unified and passionate support from the industry to push Congress to take affirmative action and pass the bill.

Update on Right to Repair legislation (00:01:50)

Enforcement of the law (00:03:15) The judge denied the request for an injunction, and the law is now in effect and can be enforced. However, the attorney general’s office has no immediate plans to enforce the law, which may require private lawsuits by consumers or owners of vehicles to go out and enforce the law.

Challenges in complying with the law (00:04:40) The OE’s view is that the law is impossible to implement, and therefore they can’t comply with it. The aftermarket has a different view and demonstrated to the judge in the trial that there were multiple ways to accomplish what the law requires.

Supporting Right to Repair (00:06:12) Encouragement to support Right to Repair legislation by completing a form on autocareadvocacy.org

Importance of Right to Repair (00:07:35) Discussion of the importance of Right to Repair legislation for free market competition and consumer choice, and the need for people to let their congressperson know that it matters to them.

Maine Right to Repair Initiative (00:11:36)

Democracy Win in Massachusetts (00:12:51) Paul McCarthy discusses the recent decision in Massachusetts as a win for democracy, as consumers voted overwhelmingly for the Right to Repair law.

Monetization of data (00:17:10) The OES’s desire to make money off of data and the fear of losing revenue streams.

The Reasonable Bill (00:20:20) The Repair Act is a reasonable bill that seeks to ensure safety and cybersecurity in vehicle repairability. It is something the whole industry should support.

Action Timebound (00:22:05) It is critical to show unified and passionate support for the Federal Repair Act by signing the petition on repairact.com. The goal is to have a public hearing by the end of summer or early fall.

Key Talking Points

Massachusetts helped set the tone two years ago, but it is embroiled in a fight between the OEs and the voters and a judge who has yet to make a ruling. There are recent discussions that 75% to 25% of voters approved overwhelmingly

“The right to repair is alluring in its simplicity. In theory, it seems obvious that if you do buy something, you own it, and you should have the freedom to do what you want with it,” said U.S. Rep. Claudia Tenney (R-N.Y.), ranking member of the subcommittee. “The right to repair, if properly designed, can create a world of consumer choice, competitive pricing, and potential cost savings.

“However, when this issue is examined in full depth, it becomes substantially less black and white,” she said. “Today, many machines are essentially sophisticated supercomputers… they perform seemingly miraculous feats thanks to delicate and complex electronic components integrated with highly specialized, proprietary software. Even with all the possible tools and resources at one’s disposal, attempting to sell, fix, or modify products with electronic components could lead to disastrous results, such as product failure or, even worse, serious injury to the consumer. In addition, these alterations can put the privacy and security of the user at risk.”

To industry: Do not abandon your interest in this initiative. Access to data is critical for the survival of our industry. This is anti-consumer because there isn’t enough bays or technicians in the dealer network to service the repair and maintenance of our car park. It is also pro-consumer as it creates competition.

What can we do? Right to repair needs to be on 20 and networking group agendas. We must speak to our legislators

If you own a shop, you must make an appointment with your local congressperson’s office and see your congressperson in person. Don’t be nervous to share with your customers- we are at the tip of the iceberg

By 2020- 4% had advanced connectivity that allowed for remote diagnostics. By 2025 almost every new vehicle will have that advanced connectivity

Supply Chain: Getting Parts to Market Post Pandemic Part 2 [RR 694]

After the overwhelming response to our first Supply Chain episode, I decided to follow up with Part 2 while at AAPEX 2021. Every day seems like there is a new challenge or problem to overcome. The squeeze of supply issues and parts availability are felt throughout our entire industry. Did you ever stop to consider this crisis isn't a supply chain problem, but rather an increase in demand? Which is actually a good problem to have. This has forced every manufacturer to improve their efficiency and focus on a better connection with shops in order to service them properly. Let’s bring both sides together and continue to keep the dialogue open and transparent.

Key Talking Points

The biggest disruption in the supply chain since World War II- demand coming out of the pandemic, the reason for inflation. Not a singular problem, it’s the entire system being overwhelmed. COVID restrictions with overseas ports.

Shipping issues and delays- ports backed up, just being able to get space on a truck or shipping containers. Shipping container fee for the boat is 20K. Starting to use more airfreight.

Truck issues- access and drivers

Raw material shortage- chemicals, oil, microchips, steel etc.

Labor issues- working in plants and warehouses. Stimulus is keeping a lot of people at home. Labor inflation

7,000 workshops in the USA- busy as they want to be as they manage their capacity.

1 million jobs available in industry plus retirement is a double edge sword.

Nearshoring is growing- less supply risk but labor issue is still prevalent

Quality issues- competitors with the same part available are made in low-cost countries. You need customer satisfaction, the brands that you long trust for quality are still brands to trust. Top shops want the best quality parts.

Manufacturer website- Knowyourparts.com

How long will it last? How long will we see this level of demand for repair shops? This year that will have over 11% growth over last year. Next year over 5% growth. 2023 and 2024 growth slow of course, but is still above the pre-pandemic trend.

Electrification- more opportunity than threat for the aftermarket, be ahead of the curve.

Bill is engaging the automotive aftermarket to get involved in letting your legislators know the issue about data. Your help is needed to help in amending the right to repair legislation. Learn everything you can about this fight to amend the right to repair legislation. Ownership of Vehicle Telematic Data Must Flow to the Vehicle Owner.

Paul McCarthy - The importance of Marketing and Relationship Building

I’m having a conversation with AASA’s President, Paul McCarthy. Our discussion went wide and we covered important topics that positively affect the aftermarket service industry. I walked away with a good feeling that Paul and the Automotive Aftermarket Suppliers Association have a handle on the opportunities and challenges of the service professional.

Paul McCarthy explains what AASA is doing to help bridge the connections with OE’s, suppliers and the service professional. You get to hear the latest trending talking points being discussed at all levels of our industry like the fears surrounding OEs support of the aftermarket, rideshare in NYC, consumer attitude due to the overcharged talk of recession, and the access and security of our data and more. It is good to see that Paul McCarthy and AASA are all over this and we benefit.

Prior to his promotion, Paul served as executive vice president of AASA, helping its president lead the association. He also served as senior vice president, strategy, for MEMA, the parent organization of AASA, Heavy Duty Manufacturers Association (HDMA), MERA – the Association for Sustainable Manufacturing and Original Equipment Suppliers Association (OESA).

Paul has 23 years of experience in the automotive industry. Prior to joining MEMA, Paul led the Automotive and Industrial Products Strategy Practice at PricewaterhouseCoopers (PwC).
