• Massachusetts helped set the tone two years ago, but it is embroiled in a fight between the OEs and the voters and a judge who has yet to make a ruling. There are recent discussions that 75% to 25% of voters approved overwhelmingly
• “The right to repair is alluring in its simplicity. In theory, it seems obvious that if you do buy something, you own it, and you should have the freedom to do what you want with it,” said U.S. Rep. Claudia Tenney (R-N.Y.), ranking member of the subcommittee. “The right to repair, if properly designed, can create a world of consumer choice, competitive pricing, and potential cost savings.
• “However, when this issue is examined in full depth, it becomes substantially less black and white,” she said. “Today, many machines are essentially sophisticated supercomputers… they perform seemingly miraculous feats thanks to delicate and complex electronic components integrated with highly specialized, proprietary software. Even with all the possible tools and resources at one’s disposal, attempting to sell, fix, or modify products with electronic components could lead to disastrous results, such as product failure or, even worse, serious injury to the consumer. In addition, these alterations can put the privacy and security of the user at risk.”
• To industry: Do not abandon your interest in this initiative. Access to data is critical for the survival of our industry. This is anti-consumer because there isn’t enough bays or technicians in the dealer network to service the repair and maintenance of our car park. It is also pro-consumer as it creates competition.
• What can we do? Right to repair needs to be on 20 and networking group agendas. We must speak to our legislators
• If you own a shop, you must make an appointment with your local congressperson’s office and see your congressperson in person. Don’t be nervous to share with your customers- we are at the tip of the iceberg
• By 2020- 4% had advanced connectivity that allowed for remote diagnostics. By 2025 almost every new vehicle will have that advanced connectivity

Without access to data, the independent service professional will not be able to get specific diagnostic data from the vehicle.

• They do have a foundation to stand on for why they should not allow access to mechanical data except for monopolization
• In Europe you have to do to the OEMs cloud for data and pay for it
• Aaron Lowe “If the manufactures determine the terms of the data, the independent part of the industry is dead”.
• This is a anti consumer initiative that would take choice away
• If they totally controlled the data the OEMs could determine who sells their cars
• Bill Hanvey: “It is ironic that the OEMs are criticizing the aftermarket for an accusation that is not true about accessing personal data, yet their business model is built upon selling that personal data”.
• Aaron Lowe is working with other industry groups and associations to work on federal legislation
• Opposition is spending a lot of money because they have a bad message
• In 2012 we won the Right To Repair by a 84%-16% margin. It won’t be that wide this time
• Message is simple: concentrating on consumer choice. It resonates with consumers and the voters in Massachusetts

Paul T. McCarthy is the President of Automotive Aftermarket Suppliers Association. AASA is the voice for the automotive aftermarket supplier industry.

Paul McCarthy assumed the position of president and chief operating officer of Automotive Aftermarket Suppliers Association (AASA), the light vehicle aftermarket division of the Motor & Equipment Manufacturers Association

(MEMA), in July 2019. As AASA’s top executive, he is focused on its mission: to advance the aftermarket industry and the business interests of its members and to support a high-growth, profitable, innovative and influential aftermarket supplier industry.

Prior to his promotion, Paul served as executive vice president of AASA, helping its president lead the association. He also served as senior vice president, strategy, for MEMA, the parent organization of AASA, Heavy Duty Manufacturers Association (HDMA), MERA – the Association for Sustainable Manufacturing and Original Equipment Suppliers Association (OESA).

Karim Morsli owner of Winkler Automomotive in Gaithersburg, MD,  is an engineer by trade who has worked in the oil fields and information technology industry. Karim is passionate about the new direction the automotive industry is taking, and in particular, the critical role independent service centers will need to evolve into to ensure all present and future car owners will have the choice of where to have their vehicle serviced besides the dealership.

He is an innovator who works on multiple levels within the industry (education and legislative) to ensure his service center and others like his are ready for the challenges ahead. Bill Nalu is President of Interstate Auto Care in Madison Heights, Michigan and has been in business for 30 years.  He collaborates with industry professionals, in building today’s “high-tech/old-fashioned” customer service system. Bill has been a big contributor to the podcast and he currently serves on several industries and educational advisory councils including AutoValue/Bumper to Bumper, Dorman Industries, and Cardone. Amending Legislation for Telematic Data Ownership

My guest is Bill Hanvey, President and CEO of the Auto Care Association. Bill is engaging the automotive aftermarket to get involved in letting your legislators know the issue about data. Your help is needed to help in amending the right to repair legislation. Learn everything you can about this fight to amend the right to repair legislation. Ownership of Vehicle Telematic Data Must Flow to the Vehicle Owner.

Do you know that a car collects data as you drive? By 2022, 87% of new vehicles will be transmitting telematic data wirelessly. But who owns the data? The car manufacturer does. Without access to data, the independent service professional will not be able to get specific diagnostic data from the vehicle.

Bill Hanvey is the President and CEO of the Auto Care Association. Bll leads the strategic direction of The Auto Care Association’s 3,000 members and 150,000 companies representing automotive manufacturers, distributors, and service providers.

    • US-Mexico-Canada agreement (USMCA), also known as NAFTA 2.0 or the new NAFTA, is slated to replace the North American Free Trade Agreement in 2020. It has already received tentative approval from top leaders of all three countries.
    • The agreement is important, as the supply chains in all industries — automotive included — depend on the ability to move good through all three countries. A strong North American trading economy is good for suppliers and helps support continued growth
    • Bill Hanvey, president and CEO of the Auto Care Association, testified before the U.S. Internal Trade Commission about the importance of the agreement, which has helped to grow the automotive industry over the past 20 years
    • The impact on repairers is indirect, but important. We need a competitive parts marketplace with choices and competition.

Chris Gardner, MAAP, is Vice President of the Automotive Aftermarket Suppliers Association He manages all technology areas for AASA members, including the AASA Technology Council and the AASA Technology Conference. The AASA Technology Conference is the leading technology event in the North American Automotive Aftermarket industry. He represents members on the Aftermarket Telematics Task Force, AASA Telematics Working Group, NASTF’s Equipment & Tool Committee, and the AASA Vehicle Data Work Group. Mark Bogdansky is the Senior Director of Meetings and Events for the Auto Care Association. He is responsible for strategic planning and tradeshow management for the Auto Care Association, including the AAPEX and HDAW shows. Prior to joining the Auto Care Association, he was VP of exhibit operations at the National Retail Federation. While at NRF, he oversaw several nationally recognized and awarded trade shows, that were consistently among the country’s biggest and fastest-growing. Ryan Clo is a nineteen-year veteran of the Automotive Service industry. He currently owns two specialized Automotive Service businesses located in Cincinnati, OH. Both businesses have systems and processes in place so that his presence is not required on a daily basis. Ryan’s first business, Dubwerx, has a 99% customer satisfaction rate while maintaining profitability and growth.

Ryan currently consults for the Institute of Automotive Business Excellence providing guidance to automotive businesses including on-site evaluations, off-site coaching, business plan development, and one-on-one coaching with owners and staff. He is known as the “Systems and Processes guy.” Ryan teaches several business management classes for the Automotive industry.

Ryan is also involved in the growing startup community in Cincinnati, OH meeting with other entrepreneurs regularly to discuss best practices and the future of business. Ryan volunteers his time serving on the editorial board for an industry magazine and two community non-profits in Cincinnati, OH.

Dave Hobbs – Automotive Training Instructor & Technical Writer

Dave Hobbs’ automotive service experience spans 40 plus years in the industry, starting out as a technician and then as a service manager working in his family’s repair shop (Hobbs Auto Electric) in Kokomo, Indiana.  After leaving Hobbs Auto Electric, Dave began working as a hotline advisor and field engineer at GM’s Delco Electronics.  Those roles eventually led to becoming an electronics systems instructor for thousands of Delco Electronics / Delphi engineers throughout North American and Asia.

Dave Hobbs is currently the lead technical trainer and course developer for Delphi Product and Service Solutions.  In addition, he serves part-time as a contributor to Motor Age Magazine and as a field correspondent for MACS Worldwide (Mobile AC Society).

Matt Fanslow is the diagnostic tech/shop manager for Riverside Automotive in Red Wing, MN. His primary responsibilities are to diagnose driveability and electrical/electronic issues, and perform most all programming, coding, initializing, adaptions, etc. Basically, if it needs to be figured out or has wires, it goes to Matt. He’s been a tech since 1996. Matt is also a subject matter expert for ASE and a trainer.

Matt has participated on 18 ASE technical committees for the ASE Practice Test, A6, A7, A8, and L1 tests. He’s also done case studies for Standard Motor Products.  Matt teaches for PICO.

You would have found Matt here at AAPEX in the Pico Technology booth as well as presenting at the AAPEX/AVI Mobility Park for Pico on using the relative compression test with a Pico Scope.

Matt also does instructor lead training for Pico Technology, AES wave and ASA Midwest (Vision).  The Pico Technology gigs have him over the country, Canada, and Puerto Rico.

Extended Bio’s:

Bill Hanvey is president and CEO of the Auto Care Association. Before becoming president and CEO on Dec. 1, 2015, Hanvey served as senior vice president of the Automotive Aftermarket Suppliers Association (AASA) since 2012.

At AASA, he managed their headquarters operations while advocating for North American parts manufacturers to the auto care industry, federal and state government agencies, and the business community. Hanvey has spent his entire 25+ year career in the aftermarket. After earning his bachelor’s in mass communications and PR at St. Bonaventure University, Hanvey began his career with extensive field sales experience and increasing management roles at Tenneco Automotive. Hanvey then became the marketing director, FleetPride, where he developed and executed a strategic marketing plan integrating 37 separately-owned companies into what is now the largest independent heavy duty parts distributor.

Hanvey went on to become VP, marketing, Dorman Products, Inc., leading creative and data services, trade marketing and product communications, doubling sales of “OE dealer exclusive” parts, automotive hardware and brake parts sold under the Dorman brand. Hanvey then became VP, sales and marketing, Schaeffler Group USA, leading the North American aftermarket team while developing and implementing a new company strategic direction, transitioning its sales and product focus from co-man to direct sales.

Hanvey served as chairman of the Auto Care Association Marketing andCommunications Committee from 2009-2012, and has participated in the “Be Car Care Aware” consumer education campaign. As staff liaison for the Brake Manufacturers Council, Hanvey worked with the Auto Care Association on the Memorandum of Understanding (MOU) with the Environmental Protection Agency (EPA) that seeks to reduce the content of copper in brake pads, and also coordinated with the association on the operation of the Automotive Specialty Products Alliance (ASPA).

Bill Hanvey was awarded the Northwood University Educator of the Year Award in 2014, and served as keynote speaker at the 2012 and 2015 Alliance Annual Group meetings and the 2010 and 2014 Babcox Executive Forums. Hanvey served on the board of directors of the Automotive Communications Council in 2008, and participated in the Right Management Executive Training Program in 2011.

Bill Long, MAAP, is President and Chief Operating Officer Automotive Aftermarket Suppliers Association (AASA), the light vehicle aftermarket division of the Motor & Equipment Manufacturers Association (MEMA).

Bill Long joined AASA in July of 2012 as executive vice president and was named president and chief operating officer in November of 2012. In September of 2015 Bill was named Executive Vice President Government Affairs for MEMA in addition to his role as AASA president.

Long is a respected and highly recognized industry leader with more than 30 years of light vehicle and heavy-duty aftermarket supplier experience. Before joining AASA in 2012, Long served as president of Long Strategies LLC and as managing partner of BC Partners LLC, providing business improvement strategies and marketing leadership services to the automotive aftermarket industry since October 2009. Prior to this, he served as executive vice president, North American Operations, Proliance International Inc., a market-leading heat exchange and temperature control manufacturer.

Bill is most recognized for his 25 years at Echlin/Dana’s Engine Management Division, where he led the company’s NAPA Echlin and Borg-Warner business; Beck/Arnley WorldParts; Ristance wire and Cable; and Accel, Hurst and Mr. Gasket business units and brands.

Long is well known in motorsports circles, where he served as a corporate officer for NASCAR in Daytona Beach and as a top executive for the IndyCar Series and the Indianapolis Motor Speedway, responsible for driving growth and relevance.

Long currently serves on the board of the National Automotive Service Task Force (NASTF), the Northwood University Automotive Aftermarket Advisory Board and the Automotive Aftermarket Charitable Foundation Board. Long is also a past chairman of the National Car Care Council.

Mr. Long was awarded the prestigious MEMA Triangle Award 1999 and Northwood University’s Automotive Aftermarket Management Education Award in 2000, both recognizing his work legislative and regulatory initiatives in educating federal lawmakers on issues concerning the industry’s access to vehicle on-board diagnostics and repair information, which has helped the suppliers and the industry in retaining the ability to participate on a level playing field.
